Terms and conditions of shipping, delivery and payment

Special items and second-hand electronic equipment

Errors in descriptions excepted despite careful avoidance.

Quotations and deliveries are subject to the following terms and conditions which form part of the sales agreement:

1. All prices quoted in the internet are exclusive of VAT. Customers resident within the European Union should add VAT at the current rate of 19%.

2. All quoted equipment originates from army or public agency stocks, wound-up companies or similar; such equipment is second-hand unless otherwise specified. All quotations may also, of their nature, concern single items. Pictures published on our homepage do not necessarily show the item actually supplied, they are for illustration purposes only.

3. Quotations are without obligation. We reserve the right to price adjustments and prior sale. Subsidiary agreements must be made in writing. Pictures published do not necessarily represent the item offered, they are for demonstration purposes only. The item supplied may be different from the item shown on picture.

4. Equipment cannot be rented, nor do we accept orders on trial or approval.

5. Consumer protection notice: all (EU resident only) non-commercial users have the right to cancel their order within 2 weeks following receipt of the goods. No reasons have to be given for cancellation, but it must be done in writing on a permanent data carrier or by returning the goods to Helmut Singer Elektronik Vertriebs GmbH, Feldchen 16-24, D-52070 Aachen. Compliance with this deadline shall be recognised provided the goods are dispatched on time. For orders below the value of EUR 40.-, the return postage shall be assumed by the returning party. The value of the goods shall be reimbursed by us immediately (please state bank details) . Take-back of goods without obligation from private customers and from commercial customers: We do charge a Restocking Fee of 15% of the net value of the goods, however a minimum fee of Euro 35 Euro, which will be subtracted from the refunded amount.

6. All shipments must be paid cash on delivery without deduction unless otherwise agreed. Prepayment or VISA/MASTERCARD payment possible as well.
A handling fee of 3.5% shall be charged for payments by credit card.

7. Deliveries on account to public bodies, industrial companies, universities or major concerns known to us are only possible subject to a written order.

8. Compensation due to default or non-fulfilment of the purchase agreement is excluded. Delivery times shall only become binding once confirmed in writing. Deliveries shall take place exclusively ex factory from Aachen, and at the account and risk of the ordering party.

9. Packaging and shipping expenses shall be charged at cost price.
Goods with an order value above EUR 750.- are delivered freight prepaid by us within Germany or to German border, except for quotations marked “carriage additional”.

10. The minimum order value is EUR 25.- for domestic orders and EUR 50.- for foreign orders - to keep the goods value in proportion to the shipping costs.

11. Warranty conditions: second-hand equipment quoted as “tested and in working order“ is warranted for 1 (one) year. We do however charge depreciation costs on a pro rata basis, based on the assumption of 12 months‘ remaining trouble-free use. If a guarantee claim is made after one month, for example, we will assume 91,67% of the repair costs and the customer only 8,33% (1/12). In case of a warranty claim after two months, we will assume 83,34% and the customer 16,66% (2/12) pro rata, etc.
Shipment to us shall take place at the account and risk of the sender; non prepaid deliveries will not be accepted. In the case of equipment which is quoted as having undergone “basic testing”, we only guarantee the basic functions: minor errors are possible. Equipment quoted “as is” must be assumed to be in need of repair and not covered by any warranty. The warranty shall not apply if the equipment is interfered with by the customer, nor if the applied seals are damaged. Wearing parts are not covered by the warranty.
Also excluded from the warranty are errors caused by incorrect operation / use of the equipment.
In a warranty case we will partly refund the cost of sending back the item on a basis of cheapest way of sending – for example Surface Mail. Any additional cost, for example Express Shipment, we not be refunded.

12. In case of damage in transit, an affidavit is requested. In addition, the postal service, UPS, railway company or carrier should be asked to submit a factual report. This still applies if no damage to the packaging is perceptible. Before the return of the damaged goods is initiated, our instructions must be obtained. The return delivery takes place at the sender’s risk, and the transport costs are charged to his account. If a defect is discovered, the only claim options are rectification and, should this prove impossible, return or cancellation of sale.

13. Scope of delivery: Accessories originally supplied with the new equipment are not included unless otherwise specified. Equipment is supplied with a free copy of the operating instructions (where available), but not of the service documentation, which can be ordered (where available) subject to an extra charge.

14. Should individual conditions be or become legally invalid or should an omission arise in the agreement, this shall not affect the validity of its content as a whole.

15. The agreed court of jurisdiction is Aachen, Germany. In case of a dispute, the German version of our “business terms and conditions” apply, furthermore German law and jurisdiction.
